Contractual agreement related to your sign up for the online POWERFX Course (”Course”)

Note: This agreement is required to be entitled to receive the online POWERFX Course, and to obtain the related Course’s material.

A- NON-DISCLOSURE AGREEMENT

In consideration of receiving the online POWERFX Course, and getting all related Course’s material, I hereby agree and acknowledge that the POWERFX Course and the related Course’s material will disclose to me proprietary information belonging to Grace Cheng Media Inc and Grace Cheng, said proprietary information consisting of, but not limited to: technical and fundamental information related to trading the Forex market, specifically: strategies, systems, the application and combination of chart indicators, trading and money management rules and guidelines, logic, pyschology, parameters, etc. In consideration of receiving the proprietary information of the online POWERFX Course and related Course’s material, I declare that:

1. I am registering to this Course for my own personal benefit and no one else.

2. I have not been asked by anyone else to register to this Course for their benefit.

3. I am not employed by a Forex dealer or Broker.

4. I will never use the information contained in this Course for the benefit of any employer, present or future.

5. I will not disclose to others any content of the Course in any form without express written permission from Grace Cheng Media Inc and Grace Cheng.

6. I agree not to share my User ID and Password with any other person.

7. I will not train others with the knowledge contained in the online POWERFX Course and the related Course’s material, nor am I affiliated, either directly or indirectly, with any organization involved in Forex training or teaching.

8. I understand that should I intentionally or unintentionally allow others access to the content of the online POWERFX Course and related Course’s material or share Course content or teach others without being authorized by Grace Cheng Media Inc and Grace Cheng in writing to do so, I am both personally and financially responsible for their Course fees as well as the Course fees of any subsequent individuals who in turn are given any of the content of the online POWERFX Course and the related Course’s material.

In the event of a breach of any of these conditions, I agree that Grace Cheng Media Inc and Grace Cheng may notify any third party of the existence of this agreement, and Grace Cheng Media Inc and Grace Cheng shall be entitled to full injunctive relief for any breach including, but not limited to, the relief outlined in paragraph eight (A8) above.

B- RISK DISCLOSURE

1. Trading currencies involves risk, and there is always the potential for loss. Your trading results may vary. No representation is being made that the online POWERFX Course, and any associated advice or training, will guarantee profits, or not result in losses from trading. Neither the products, any explanation or demonstration of their operation, nor any training held in conjunction therewith, including, without limitation, through online chat, in conjunction with any advertising and promotional campaigns, during in-person seminars or otherwise, should be construed as providing a trade recommendation or the giving of investment advice. The purchase, sale or advice regarding a currency can only be performed by a licensed Broker/Dealer. Before deciding to invest in foreign exchange, you should carefully consider your investment objectives, level of experience, and risk appetite. The possibility exists that you could sustain a loss of some or all of your initial investment, and therefore you should not invest money that you cannot afford to lose. You should be aware of all the risks associated with foreign exchange trading.

2. I have read the risk disclosure stated in paragraph one (B1) above that explains the risks associated with currency trading and the limitations of hypothetical trading systems and their performance results. I understand that there is no trading system or trading advice that is free from the risk of loss, and that no one can guarantee profits or freedom from loss in currency trading. I understand that Grace Cheng Media Inc and Grace Cheng CANNOT and WILL NOT guarantee that I will make a profit, and agree that Grace Cheng Media Inc and Grace Cheng will not be held responsible for any trading losses.

3. I understand that Grace Cheng Media Inc and Grace Cheng do not endorse or encourage the trading of forex, futures and/or options contracts. I also acknowledge that the parties providing Forex training are not CTA’s (Commodity Trading Advisors) or Commodity Brokers. I hereby agree to indemnify and hold Grace Cheng Media Inc and Grace Cheng harmless from any and all losses, costs, liabilities, or indebtedness arising from the use of any trading information, course information, technique, method, system or vendor shared with me.

4. I understand that the Course content is put forward in good faith, and believed to be accurate, however there are no implicit guarantees of accuracy. I accept that by using this information, I will not hold Grace Cheng Media Inc and Grace Cheng responsible for decisions based on information from the Course.

5. Grace Cheng Media Inc and Grace Cheng are not responsible for the actions of any broker, dealer, broker-dealer or other intermediary through whom I makes transactions. I am responsible for investigating and selecting any such broker, dealer, broker-dealer or other intermediary before doing business with such person.

C - REFUND POLICY

1. Grace Cheng Media Inc and Grace Cheng offer a 3-day, 100% money-back guarantee for the online POWERFX Course, provided that the written request for refund is received and confirmed by Grace Cheng Media Inc and Grace Cheng by 0001 GMT on the third day of the Course. All sales relating to mentoring services or email support services are non-refundable and not exchangeable. The refund policy does not include transaction costs incurred for receiving and refunding payment.

2. Grace Cheng Media Inc and Grace Cheng reserve the right to ban clients without refund for unprofessional actions to include but not limited to profanity, racism, slander toward Grace Cheng Media Inc and/or Grace Cheng, recruitment to competitive services, sharing Course content and all information included in our website without approval in writing.

D - COST OF COURSE/COACHING AND LESSONS SCHEDULE

1. I understand that I have to pay the cost of the online POWERFX Course in its entirety before the beginning of the Course . Upon receipt of full payment, Grace Cheng Media Inc agrees to give me access to the online POWERFX Course materials from one computer.

2. I understand and accept that each time I enter my User ID and Password to access the online POWERFX Course materials, a record of my IP address and location will be logged on to the PowerFX Course server.

E - EMAIL SUPPORT

Email Support by Grace Cheng is bound by the following conditions:

1. I understand that the Email Support will either span four (4) weeks or sixteen (16) weeks, depending on which option I have chosen.

2. I understand that questions are only limited to the Course’s topics and general trading questions.

3. I will not ask questions relating to Grace Cheng’s current trading strategies, plans, decisions, and /or Grace Cheng’s opinions on current and future market conditions or ask for Grace Cheng’s opinions on my trading decisions, strategies or plans. I understand that personal questions and/or any topics unrelated to the Course are out of bounds, and will not be entertained.

4. I understand that the Email Support is only limited to email communication, and not via other forms of communication.

5. I understand that email replies can take up to two (2) business days from the time of receiving, excluding weekends, and bank or public holidays in the United States. Grace Cheng will not be held liable if she is unable to respond within that time due to any unforeseen circumstances.

Grace Cheng Media Inc and Grace Cheng reserve the right to change any of the terms and conditions without prior notice.
